What is the sweepstakes?
The Tamagotchi L.i.f.e. (T-L.i.f.e.) Tap and Hatch“Win a Spa Day with Jennette McCurdy!” Sweepstakes (“Sweepstakes”) is an opportunity to win an all-expense-paid trip to Southern California (valued at nearly $5000), including airfare, two nights’hotel accommodations, and $500 cash, highlighted by a Spa Day for you and a friend with Jennette McCurdy, and other exciting prizes, to celebrate the release of the FREE iOS and Android Tamagotchi L.i.f.e. Tap and Hatch app. This Sweepstakes is offered by Sync Beatz Entertainment, Inc., a California corporation, located at 5959 W. Century Blvd., Suite 840, Los Angeles, CA 90045 and its affiliates (the“Company”).
One (1) entrant and guest will win a trip to Southern California and get the star treatment including a pampered mani/pedi with Jennette, and 20 runners-up each will receive an autographed Tamagotchi L.i.f.e. Tap and Hatch T-shirt signed by Jennette McCurdy, as set forth below.
This Sweepstakes begins on March 26, 2014, the day of the release of the Free Tamagotchi L.i.f.e. Tap and Hatch iOS and Android Apps, and ends April 30, 2014 at 12:00 midnight PDT. The winner will be notified within 30 days of the close of the Sweepstakes. The prize will be awarded within six months of the confirmation of the winner. How do I participate in the sweepstakes?
Participants must be citizens or legal residents of the United States and must be at least 18 years of age on the first day of the Sweepstakes. There is no purchase necessary to enter. Employees of the Company and its affiliates are not eligible to enter or win. By participating in the sweepstakes, you are agreeing to these rules governing the sweepstakes, as well as the rules for Facebook, Twitter and/or Pinterest if sweepstakes entries are made through those methods. You may enter once in each of the methods provided in the online instructions, for up to three chances to win. Go to https://tamagotchilife.com and follow the online instructions and click on the“enter”button on the Sweepstakes page. “Liking” our Facebook Tamagotchi L.i.f.e. page is a requirement. You can enter two more times by agreeing to follow the official Tamagotchi L.i.f.e. Twitter feed @mytamalife, or by agreeing to follow us on our Tamagotchi L.i.f.e. Pinterest page.
How is the winner determined?
The sweepstakes winner (“Winner”) will be selected at random and determined by the Company in its sole discretion. The Winner will be notified by mail, phone, and/or e-mail in Company’s sole discretion. The potential winner may be required to execute and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within forty-eight (48) hours of receipt. If such documents are not returned within the specified time period, if a prize or prize notification is rejected, faulty or returned as undeliverable, if Company is unable to contact a potential winner within 48 hours of notification, or if a potential winner is not in compliance with these Official Rules, all prizes will be forfeited and, at Company’s sole discretion, an alternate winner selected for the Sweepstakes at issue.
Prize List
The one (1) grand prize is an all-expense-paid trip with round-trip airplane tickets (with no more than one connection in each direction of the trip), accommodations for two nights at a hotel of Company’s choice, $500 cash for the grand prize winner, and a Spa Day for you and a friend with Jennette McCurdy at Company’s facility of choice. Twenty (20) runners-up will each receive one Tap and Hatch T-shirt (one of four colors) autographed by Jennette McCurdy, randomly selected by Sync Beatz Entertainment and shipped (at no charge) to the identified winners. Winners agree that the prize is awarded “as is” with no warranty, representation or guarantee, either express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the prize, including, without limitation, its quality, merchantability or fitness for a particular purpose. The Winners may not substitute, assign or transfer a prize or redeem a prize for cash and, in accepting the prize, agrees not to resell the winning item. Winner is responsible for all applicable federal, state and local taxes, if any. Company will not replace any lost, mutilated or stolen prize or any prize that is undeliverable or does not reach the Winner for any reason, including, without limitation, because of incorrect or changed contact information. No more than the stated prizes will be awarded. All prizes legitimately claimed will be awarded. The approximate retail value of the grand prize is $5,000. The approximate retail value of the runners-up prizes are: $100.
Chances of Winning
Twenty-one prizes will be awarded. Any entrant’s chances of winning will be determined by the number of entries they make (up to three) relative to the total numbers of entries by all participants.
Disputes
Company is not liable for technical failure or other errors or difficulties of any kind whether human, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes and the winners, or in any Sweepstakes-related materials. Participants and nominees, by participating, agree that Company and its respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, members, managers, contractors, employees, representatives and agents, Facebook, Twitter and Pinterest (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, awarding or use of any prize (including any activity related thereto) or while preparing for, participating in and/or traveling to or from any prize- or Sweepstakes-related activity. All Sweepstakes participants hereby agree that any and all disputes regarding this Sweepstakes will be settled through BINDING ARBITRATION HELD IN LOS ANGELES, CALIFORNIA BEFORE A SINGLE ARBITRATOR FROM JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC. (“JAMS”). This Sweepstakes is void where prohibited.
Except where prohibited, as a condition of participating in this Sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the entrant and any Released Party, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’fees, other than entrant’s actual out-pocket expenses (if any), not to exceed two hundred fifty dollars ($250), and entrant further waives all rights to have damages multiplied or increased.
Applicable Law
All issues concerning this sweepstakes shall be controlled by and construed under the laws of the State of California. California law shall govern interpretation and enforcement of Sweepstakes, regardless of conflicts of laws principles. Each party shall bear its own costs and attorneys fees in any such action or dispute.
