Hometown Heroes Contest Official Rules
XWhat is the contest?
Hometown Heroes is a series of six contests for a chance to win $5000 offered by Sync Beatz Entertainment, Inc. a California corporation, located at 5959 W. Century Blvd., Suite 840, Los Angeles, CA 90045 and its affiliates (the "Company"). A combined total of $30,000 will be awarded to six contest winners ($5000 to each winner). The contest periods are January – February, March – April, May – June, July - August, September – October, and November – December 2013. All votes must be received by 11:59 p.m. Pacific Standard Time on the last day of the contest (2/28/13, 4/30/13, 6/30/13, 8/31/ 13, 10/31/13 or 12/31/13.) Winners of each contest will be notified within 30 days of the close of each contest. Prizes will be awarded within 45 days of the close of the contest.
How do I participate in the contest?
Participants including nominees and voters must be citizens or legal residents of the United States. Nominees and voters must be at least 18 years of age on the first day of the contest. There is no purchase necessary to enter. Employees of the Company and its affiliates are not eligible to enter or win. Who can be nominated?
You may nominate anyone, including yourself to be a Hometown Hero. The nominees should have contributed to their community in a charitable way. This could include raising money or donating time, bringing public attention to an important cause, using initiative and creativity in for a charity, or other charitable actions in which they have helped others. The nomination should explain why you believe the nominee is a hero and has helped others in 100 words or less. If a nomination is made towards the end of a contest voting period, Company may hold the nomination until the next contest period and enter the nominee for that subsequent period. All nominees will be evaluated and are subject to approval by Company. Company reserves the right to not accept any nominee who, in Company's sole discretion, it not appropriate for the contest. How does voting work?
Voters may cast one vote per person per day online during the contest period. We consider a single IP address a "person" . To vote, go to https://tamagotchilife.com/heroes/ and follow the online instructions.
If more than one qualified voter would like to vote and you share an IP address, or you are having difficulty voting on-line, you may mail your votes to our contest administrators at the following address: 5959 W. Century Blvd. Suite 840 Los Angeles, CA 90045. Votes must be mailed in separate envelopes and postmarked on different dates. We reserve the right to not include votes where it appears that voters may be attempting to vote more than one time per day. Abuse of the voting process will result in participants being barred from engaging in any of our contests and/or from the Website. The decision to exclude votes, voters, or nominees shall be made in Company's sole discretion. We reserve the right to modify the way we identify voters at any time.
How are winners determined?
Winners will be determined by the Company in its sole discretion. Factors considered in deciding the winner include the total number of votes received during the contest period, and the nature of the charitable contribution of the nominee. The winners chosen will be the nominees that best represent T-L.i.f.e. values in the opinion of the Company, as outlined on the Tamagotchi L.i.f.e. Website "Or Story" tab. These attributes include being a good friend, being community-minded, being positive, nurturing and caring and for others, being creative, being confident, being passionate, having determination and having fun. Nominees may only win one contest. Nominees who have not won a Hometown Heroes contest may be nominated in future contests.
Winners will be notified by mail, phone, and/or e-mail in Company's sole discretion. Winners may be required to execute and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within twenty-four (48) hours of receipt. If such documents are not returned within the specified time period, If a prize or prize notification is rejected, faulty or returned as undeliverable, if Company is unable to contact a potential winner within 48 hours of notification, or if a potential winner is not in compliance with these Official Rules, all prizes will be forfeited and, at Company's discretion, an alternate winner selected for the contest at issue.
Prize List
Each of the six Hometown Heroes contests in the series will have two prizes for a single winner. Each winner will receive a check for $5,000.00 and an award statue engraved with their name.
Each winner agrees that the prize is awarded "as is" with no warranty, representation or guarantee, either express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the use or enjoyment of the prize, including, without limitation, its quality, merchantability or fitness for a particular purpose. Winners may not substitute, assign or transfer a prize or redeem a prize for cash. Winners are responsible for all applicable federal, state and local taxes, if any. Company will not replace any lost, mutilated or stolen prize or any prize that is undeliverable or does not reach the winner for any reason, including, without limitation, because of incorrect or changed contact information. No more than the stated prizes will be awarded. All prizes legitimately claimed will be awarded.Disputes
Company is not liable for technical failure or other errors or difficulties of any kind whether human, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the contest, the processing of entries, the announcement of the prizes and the winners, or in any contest-related materials. Participants and nominees, by participating, agree that Companies and its respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, members, managers, contractors, employees, representatives and agents (collectively, "Released Parties") will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, awarding or use of any prize (including any activity related thereto) or while preparing for, participating in and/or traveling to or from any prize- or contest-related activity. All contest participants hereby agree that any and all disputes regarding this contest will be settled through BINDING ARBITRATION HELD IN LOS ANGELES, CALIFORNIA BEFORE A SINGLE ARBITRATOR FROM JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC. ("JAMS"). This contest is void where prohibited.
Except where prohibited, as a condition of participating in this contest, each participant agrees that any and all disputes that cannot be resolved between the entrant and any Released Party, claims and causes of action arising out of or connected with this contest, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-pocket expenses (if any), not to exceed two hundred fifty dollars ($250), and entrant further waives all rights to have damages multiplied or increased.
Applicable Law
All issues concerning these Contests shall be controlled by and construed under the laws of the State of California. California law shall govern interpretation and enforcement of Contests, regardless of conflicts of laws principles. Each party shall bear its own costs and attorneys fees in any such action or dispute.
